Terms of Service

These terms govern your use of Appraisy. By downloading or using the app, you agree to them. The most important parts: Appraisy gives you informed opinions, not financial advice. Subscriptions auto-renew until you cancel. Disputes go to arbitration. Specifics below.

1. Agreement to terms

These Terms of Service ("Terms") form a binding agreement between you and Five to Nine Labs LLC ("we," "us," or "our"), a Massachusetts limited liability company, regarding your use of the Appraisy mobile application and the website at appraisy.app (together, "the Service").

By downloading, installing, or using Appraisy, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use Appraisy. If you are between 13 and the age of legal majority in your jurisdiction, your parent or legal guardian must agree to these Terms on your behalf.

2. License to use Appraisy

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Appraisy app on a device you own or control, solely for your personal, non-commercial use, subject to these Terms and the App Store's Terms of Service.

This license does not give you the right to: (a) sublicense, sell, lease, or distribute the app; (b) modify, reverse engineer, or attempt to derive the source code of the app; (c) use the app to build a competing product; (d) remove any copyright, trademark, or other proprietary notices.

3. No account, no warranty about results

Appraisy does not require you to create an account. Your appraisal history is stored locally on your device.

Appraisy provides informed opinions, not financial, legal, or investment advice. Appraisal results are generated by an AI model based on the photographs and context you provide. They reflect general market knowledge and patterns but are estimates, not guarantees. Resale values, return policies, market prices, and platform fees can change without notice. We strongly recommend verifying important details — particularly return windows, retailer policies, and large-purchase decisions — directly with the retailer or platform before acting on an appraisal.

You are solely responsible for any decision you make based on an Appraisy recommendation. We are not liable for outcomes resulting from those decisions, including but not limited to lost return windows, unfavorable resale outcomes, missed deals, or transactions that turn out worse than expected.

4. Subscriptions, billing, and cancellation

Appraisy offers a free tier with limited monthly usage and a paid subscription called Appraisy Plus, which removes the monthly usage cap and unlocks additional features.

Subscription terms

Auto-renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your iTunes / Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the price listed at the time of subscription, unless we have notified you of a price change in advance and you have not canceled.

Managing and canceling your subscription

You can manage and cancel your subscription at any time through your Apple ID subscription settings:

  1. Open the Settings app on your iPhone or iPad
  2. Tap your name at the top
  3. Tap Subscriptions
  4. Tap Appraisy Plus
  5. Tap Cancel Subscription

You may also access this directly from within Appraisy by going to the Manage tab and tapping the subscription row.

Canceling stops future renewals. You will retain access to Plus features until the end of the current paid period.

Pricing may vary by country or region based on local taxes and currency conversion. The current price will always be displayed before purchase confirmation.

5. Refunds

All purchases are processed by Apple. Refund requests must be submitted to Apple directly via reportaproblem.apple.com. We do not have the ability to issue refunds for App Store purchases.

Apple's refund policy is governed by the App Store Terms of Service, which generally provides for refunds at Apple's discretion within a limited time window after purchase. We may, at our discretion, provide complimentary access to Plus features in exceptional cases — contact support@fivetoninelabs.com if you believe yours qualifies.

You may not use Appraisy to:

7. Intellectual property

Appraisy, including its name, logo, brand, design, code, AI prompts, and content, is owned by Five to Nine Labs LLC and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any photographs and content you submit to Appraisy. By submitting them, you grant us a limited, non-exclusive, royalty-free license to process them for the purpose of generating your appraisal. This license terminates when the appraisal is complete; we do not retain or reuse your content.

8. Third-party services and links

Appraisy may reference, link to, or recommend actions involving third-party services (including but not limited to retailer return desks, resale marketplaces such as eBay, Mercari, and Poshmark, and listing platforms). We are not affiliated with these third parties unless explicitly stated, and we are not responsible for their content, policies, fees, or actions.

Your use of any third-party service is governed by that service's own terms of service and privacy policy. Verify return policies, fees, and listing requirements directly with each service.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, either express or implied. We disclaim all warranties to the fullest extent permitted by law, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of appraisal results.

We do not warrant that the Service will be uninterrupted, error-free, secure from unauthorized access, or that any defects will be corrected. Appraisal estimates are not guarantees of actual market outcomes.

10. Limitation of liability

To the fullest extent permitted by law, Five to Nine Labs LLC, its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, lost revenue, lost savings, lost data, or business interruption, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

In no event will our aggregate liability to you for any claim arising out of or relating to the Service exceed the greater of: (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above limitations may not apply, and you may have additional rights.

11. Indemnification

You agree to defend, indemnify, and hold harmless Five to Nine Labs LLC and its officers, members, employees, and agents from any claim, liability, damage, or expense (including reasonable attorneys' fees) arising out of: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any content you submit to the Service.

12. Termination

You may stop using the Service at any time by deleting the app from your device. If you have a subscription, deletion does not cancel it — you must cancel through your Apple ID settings.

We may suspend or terminate your access to the Service, with or without notice, for any reason, including but not limited to violations of these Terms. Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (intellectual property, disclaimers, liability limits, dispute resolution, governing law) will survive.

13. Dispute resolution and arbitration

Informal resolution first

Most disputes can be resolved without a lawyer. Before filing a formal claim, please contact us at support@fivetoninelabs.com with a description of the issue. We will attempt to resolve it informally within 60 days.

Binding arbitration

If informal resolution fails, you and Five to Nine Labs LLC agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in Massachusetts (or, at your election, in the state where you reside). The arbitrator's decision will be final and binding.

Class action waiver

You agree that any arbitration or legal proceeding will be brought only in your individual capacity, not as a plaintiff or class member in any class, consolidated, or representative action. The arbitrator may not consolidate more than one party's claims and may not preside over any form of representative proceeding.

Exceptions

Either party may seek injunctive relief in court to protect intellectual property rights or address abuse of the Service. Either party may also bring qualifying claims in small claims court.

Opt-out

You may opt out of this arbitration agreement by sending written notice to legal@fivetoninelabs.com within 30 days of first downloading the app. Your notice must include your name and the device on which you installed the app. Opting out does not waive any other provision of these Terms.

14. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any litigation that proceeds in court rather than arbitration will be brought exclusively in the state or federal courts located in Bristol County, Massachusetts, and you consent to the personal jurisdiction of those courts.

If you live outside the United States, you may have additional rights under your local consumer protection laws that cannot be waived by contract. Nothing in these Terms is intended to limit such rights.

15. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. For material changes, we will provide a more prominent notice (such as an in-app banner). Your continued use of the Service after a change indicates your acceptance of the updated Terms. If you do not agree to a change, you must stop using the Service.
